This Privacy Policy explains Raqk’s privacy practices including how we collect, store, use, share and protect your Personal Information, both on our Site and as part of the Raqk Services. This policy was last modified on 11/24/2017. By signing up for the Raqk Services or transacting with Raqk or a Shop hosted via the Raqk Services, you are agreeing to the terms of this Privacy Policy and the Raqk Terms. This Privacy Policy is a legally binding agreement between you, and to the extent applicable, the company on whose behalf you are acting, (referred to in this Privacy Policy as “you” or “your”) and Raqk, LLC (referred to in this Privacy Policy as “we”, “our”, “us” or “Raqk”). All capitalized terms that are not defined in this Policy, will have the meaning provided in the definition section of the Raqk Terms.

Throughout the policy, we will use the term “Personal Information”, which refers to information that can be used to identify or locate a specific person. Personal Information may include such details as your name, physical address, telephone number, email address, precise geographic location, shipping information, billing information, and the like.

If you submit any Personal Information on behalf of other people to us or to our service providers, you represent that you have the authority to do so and to permit us to use such information in accordance with this Privacy Policy. Personal Information provided should be accurate, complete and up-to-date.

Personal Information About You

Information you provide to us: There may be times (such as when you buy something from a Raqk shop, when you subscribe for alerts, when you register with Raqk as a Brand to sell your products, or when you register with Raqk as a Shop Curator to set up a Raqk shop, etc.) when we may ask you to provide certain information about yourself, such as your name, telephone number, email address, social media User name, credit card information, shipping address, billing address and other information.

Whether or not to provide such information is completely up to you; but if you choose not to provide the information requested, you may be unable to purchase products, or access certain services, offers and Content on our web Site or on the Raqk platform.

Information that we may automatically collect: In general, you can visit many of our web pages without telling us who you are or revealing any contact information about yourself; however, you will not be able to register to sell products or set up a Raqk shop, or subscribe to become an insider without providing us with some Personal Information. In addition to the information you may provide us when you register or subscribe with us, we may also collect information about your activity on and interaction with Raqk on our web Site or on the Raqk platform (such as your IP address, the type of device or browser you use, and your actions within the Raqk).

Information that third parties may collect: In order to facilitate purchase transactions through Raqk, we use a third-party payment processor, Stripe. If you wish to make a purchase or process a purchase through Raqk, the third-party payment processor will collect certain Personal Information to process payment. This information will be protected and used in accordance with the payment processor’s privacy policy and rather than the Raqk privacy policy. Raqk has no control over, and is not responsible for, such third-party’s collection, use, and disclosure of the Personal Information that they receive from you as part of the payment process.

How We May Use Personal Information

We, the Brands, the Shop Curators, and our service providers may use your Personal Information in the following ways:

  • To respond to your inquiries.

  • To send administrative information, notices, and announcements to you about Raqk, your account, changes in terms, guidelines, and policies, etc.

  • To fulfill a Customer order and ship your purchase to you, to process your payments, to communicate with you regarding your purchase and provide you with related Customer service.

  • To send you marketing communications that we believe may be of interest to you. If this occurs, you may opt-out of receiving these marketing-related messages from us by clicking on the “unsubscribe” link provided in each such communication.

  • To personalize your experience on the Raqk Services by presenting products and offers tailored to Raqk Brands, Shop Curators, Customers, and other Users.

  • For our business purposes, such as data analysis, audits, fraud monitoring and prevention, developing new products, enhancing, improving or modifying the Raqk platform or Raqk Services we offer, identifying usage trends, determining the effectiveness of our promotional campaigns and operating and expanding our business activities.

  • To facilitate social sharing functionality [for example a “like” button or a “share” button linking to a third party social platform].

How We May Share Information We Collect

We may share information collected on our web Site or on the Raqk platform in different ways depending on how you are using the Raqk Services. The information that we share about you varies depending on whether you are using Raqk as a Brand, a Shop Curator, or a Customer. We have described below how we share information for these categories of Users.

Brand // Shop Curator Information That Is Shared

Profile Information: When you create an account as a Brand or Shop Curator, we create a profile page for you on the Raqk Services that is publicly viewable as part of any live or historical Product Events or Raqk Shops. Whenever your company name appears within the Raqk Services (for instance, when your Product Event is featured in a Raqk Shop or when you send a Product Event Invite), visitors to Raqk can click your company name to see your profile. Here are some of the details that may be publicly viewable on your profile within the Raqk Services:

  • Information about your company such as your company name, your logo, your city, state and country, the email address you provide for Customers and other Raqk Users to contact you, the company web Site URL and any social channel URL links you provided as part of your account registration;

  • Any information you choose to add to your profile (like your bio/company description and images you added to include in your profile).

Product Events: Information about Product Events that are running live as well as historical events. Product Events may include product images, product description, product name, price, duration, order processing, shipping method, ship-to countries, terms of sale and sold by company name that was provided for each Product Event. Shop Curators may also use Produce Event information for promotional purposes.

Shop Content: Any images and Content you add to a Raqk Shop.

Invites: Shop Invites will be shared with third parties by Shop Curators who want to include a certain product in their shop. Product Event Invites will be shared with third parties by Brands who may wish to be included in a Raqk Shop. These Invites are direct communications between two parties, and, as required by our Terms of Service, should be treated as confidential by the receiver of the communication, should not be further forwarded or shared with other parties for whom the communication was not intended.

Product Event information: Brands agree to grant Raqk and Shop Curators (who accept Product Events Invites and feature Product Events in their Raqk Shop), the right to promote Product Events and sell corresponding products within the Shop Curator’s Raqk Shop. Brands agree that media, images, product descriptions, logos, trademarks, and other Content provided with each Product Event and Product Event Invite are available for Raqk and Shop Curators who accept Product Events in their Raqk Shops to be shared, reposted, and promoted during the Product Event period. Raqk bears no responsibility for the information contained within the Product Event, the Product Event Invite, or any promotional Content distributed by Brands or Shop Curators, or other Users of Raqk. In all cases, however, the creation, distribution, and publishing or posting of such Content is subject to the restrictions in this Privacy Policy and the Raqk Terms.

Customer Information That Is Shared

Third Party Payment Processor: In order to facilitate purchase transactions through Raqk, we use a third-party payment processor, Stripe. If you wish to make a purchase or process a purchase through Raqk, the third-party payment processor will collect your Personal Information to process payment. This information will be protected and used in accordance with the payment processor’s privacy policy and rather than the Raqk Privacy Policy. Raqk has no control over, and is not responsible for, such third party’s collection, use, and disclosure of the Personal Information that they receive from you as part of the payment process. For more information about the third-party processor, please refer to the Raqk Terms.

Customer Information Shared with Brands: When you make a purchase and place an order in a Shop hosted by Raqk or otherwise transact on the Raqk Services, details on the order (such as your name, the item(s) purchased, the amount of your Transaction, date of the Transaction, email address, billing address, phone number, and shipping information) are shared with the Brand for the purpose of fulfillment, providing Customer service, or otherwise to the extent specifically authorized by you to the Brand.

When you sign up to be on a Brand’s Insider email list, the name and email you provide is shared with the corresponding Brand for the list you subscribed to.

In addition, Brands may receive anonymized information about the ways people visit and interact with a Raqk shop and Product Event pages in the form of routine traffic analytics.

Customer Information Shared with Shop Curators: When you make a purchase and place an order in a Shop hosted by Raqk or otherwise transact on the Raqk Services, certain information about the purchase you made (what you bought, quantity, amount), your email address and certain demographic information about you, may be provided to the Shop Curator. Shop Curators may use this information to provide Customer service, and also to better understand their Customers.

When you sign up to be on a Shop Curator’s Insider email list, the name and email you provide is shared with the corresponding Shop Curator for the list you subscribe to.

In addition, Shop Curators may receive anonymized information about the ways people visit and interact with their Raqk Shop and Product Event pages in the form of routine traffic analytics.

Information That Is Shared with Third-Party Services

We may share information that are collected through Raqk with certain third-party service providers that help us provide, improve, promote, or protect the Raqk platform. For example, we may partner with a third-party payment processor or use cloud-based solutions to help with storage and backup of our information and systems. Third-party service providers that support the delivery of the Raqk Services, may have access to your information for the sole purpose of supporting Raqk and are bound by their contract with Raqk and their own privacy policies to protect and maintain the confidentiality of information about our Users and our systems. We may also share aggregated and anonymized information to help service providers understand trends and other analytics about our or components of our service.

Links to Other Web Sites and Social Media Widgets

Our Site may include links to other third-party web Sites. When you use these links, you leave our web Site, and the privacy policy and terms of service of the third-party web Site governs. We encourage you to carefully read and understand the privacy statement of any web Site you visit.

Our Site includes social media features, such as the Facebook Like button and widgets, such as the Share This button. These features may collect your IP address, which page you are visiting on the Raqk Services, and may set a cookie to enable the feature to function properly. Your interactions with these features are governed by the privacy policy of the company providing these social media features.

This Privacy Policy does not address, and we are not responsible for, the privacy, information or other practices of any third-parties, including any third-party operating any Site or service to which the Raqk Services link. The inclusion of a link on the Raqk Services does not imply endorsement of the linked Site or service by Raqk or by Raqk Users. Please note that we are not responsible for the collection, usage and disclosure policies and practices (including the data security practices) of third parties providing services on Raqk to whom you may provide your Personal Information.

How We Store and Protect Your Personal Information

The security of your Personal Information is important to us. We use our good faith efforts to follow generally accepted standards to protect the Personal Information submitted to us, both during transmission and once we receive it. We will protect Personal Information by reasonable security safeguards against loss or theft, as well as unauthorized access, disclosure, copying, use or modification (for example, we use Security Sockets Layer (SSL) encryption technology to encrypt sensitive Personal Information (such as your payment information and geolocation) before it travels over the internet. However, no method of transmission over the Internet, or method of electronic storage or storage, is 100% secure. Therefore, we cannot guarantee its absolute security.

Use of Services By Minors Not Permitted

The Raqk Services are not directed to individuals under the age of thirteen (13). Any access to or use of the Site or Raqk Services by anyone under 13 years of age is expressly prohibited. If it comes to our attention that we have inadvertently collected Personal Information form a person under age 13, we will take reasonable steps to delete the information as soon as possible.

Cross-Border Transfer

The Raqk Services are controlled and operated by us from the United States, when registering for, subscribing to, making a purchase, or communicating through Raqk, you must consent to the transfer of your personal data abroad, including to the US and other jurisdictions, and to generally process your information in accordance with this Privacy Policy. Unfortunately, we are unable to make Raqk available to you if you do not provide this consent.

Merger

In the event of a merger, acquisition, reorganization, or sale of nearly all of our assets, our Privacy Policy will apply to your Personal Information until notice is provided to you that the Privacy Policy is superseded by a new policy.

Information That Is Shared to Protect Raqk, its Users & Comply with the Law

We reserve the right to use and disclose Personal Information as we believe to be necessary or appropriate to third-parties to prevent, investigate, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the rights, safety, or property of Raqk and/or Raqk Users, violations of our Raqk Terms or of any other agreement related to the Raqk Services, to respond to request from public and government authorities or as otherwise required by law.

Cookie Policy

Like many other web Sites, we may place small data files on your computer or other device. These data files may be cookies, pixel tags, or other local storage provided by your browser or associated applications. We use these technologies to:

  • Recognize you as a Customer.

  • Customize our Raqk Services, Content, advertising, and marketing, and measure their effectiveness.

  • Help ensure that your account security is not compromised, mitigate risk and prevent fraud, and promote trust and safety across our Site and the Raqk Services.

We may use both session and persistent cookies. Session cookies expire and no longer have any effect when you log out of your account or close your browser. Persistent cookies remain on your device until you erase them or they expire. We may tie the information gathered to our Users' Personal Information.

Some browsers make it possible for you to signal that you don’t want your internet browsing activity to be tracked. There is currently no consensus on how to best honor these signals, so we don’t respond to “do not track” requests at this time. Declining our cookies may interfere with your use of the Raqk Site and the Raqk Services.

Our third-party service providers also may employ cookies. The use of cookies by others is not covered by this Privacy Policy.

User Access and Choice

You may, of course, choose not to provide us with any personal information, but as a result, request, you may be unable to purchase products, or access certain services, offers and Content on our web Sites or on the Raqk platform.

You may opt-out from receiving marketing-related emails. If you no longer want to receive marketing-related emails from us on a going-forward basis, you may opt-out of receiving these marketing-related emails from us by clicking on the “unsubscribe” link provided in each such communication. Please also note that if you do opt-out of receiving marketing-related emails, we may still send you important administrative message from the Raqk Services and you cannot opt-out from receiving administrative messages.

If your Personal Information changes, you may correct, update, amend, remove, or ask to have it removed by making the change on your User Account page or by contacting the email address listed below. Upon request we will provide you with information about whether we hold any of your Personal information. If you no longer desire our service, you may deactivate/delete your Account by contacting us directly.

We will retain your Personal Information for as long as your account is active or as needed to provide you or other Users with Raqk Services. We will retain and use your Personal Information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Updates to This Privacy Policy

We may update this Privacy Policy from time to time. Please take a look at the “Last Modified” date to see when this Privacy Policy was last revised. Any changes to this Privacy Policy will become effective when we post the revised Privacy Policy on the Raqk Services. Your use of the Raqk Services following these changes means that you accept the revised Privacy Policy.

Remember: You are Responsible for What You Post

As part of the Raqk Services, Brands, Shop Curators, Customers and other Users are able to post Content independently. We ask that you do not send us, disclose or post any sensitive Personal Information (e.g., social security numbers, information related to racial or ethnic origin, etc) on Raqk. Raqk takes no responsibly and assumes no liability for any User Content uploaded, posted, stored, displayed, published, transmitted or made available by you or any third-party, or for any loss or damage thereto, nor is Raqk liable for any mistakes, omissions, unintentional disclosures, or errors in any User Content. Raqk reserves the right to restrict or remove any User Content stored on the Raqk Services at any time and for any reason without notice.
