Terms Of Purchase // What to Expect
You are purchasing product directly from an independent business
When you purchase a product from a Shop hosted by the Raqk Services, you are directly supporting an independent seller (who we call a “Brand”) and a Shop Curator (someone who selects specific products from Brands to offer in their Raqk Shop). Each product is offered as part of what we call a “Product Event.” We call it an event because the product is offered for a limited time, in limited quantities, and is provided to you in accordance with specific processing times, and shipping methods, and other parameters that are unique to the product being offered at that time. All the parameters for each Product Event are set by the Brand. Raqk does not pre-screen products, Product Events, Brands or Shop Curators that use the Raqk Services. As such, it is your responsibility to ask questions and investigate a product, a Product Event or a Brand to the extent you feel is necessary before making a purchase. All purchases are made by you voluntarily and at the sole discretion and risk of you, the “Customer ”. For your convenience, the Brand’s contact information is provided in a profile page that is easily accessible by clicking on the Brand’s name, which appears in each Product Event under the product name.
You agree to the Product Event parameters
Brands create Product Events that are made available in Raqk Shops and each Product Event has its own set of parameters including but not limited to available units, time limits, terms, or other restrictions which may require you to complete a purchase within a certain timeframe or under other limitations or restrictions.
By making a purchase from a Shop hosted by Raqk Services, you agree that you:
Have read the product description and Product Event details/terms before making a purchase;
Agree to the Product Event parameters and any additional terms identified in each Product Event including but not limited to the pricing (all prices listed in USD), shipping terms, processing times, duration, terms of sale, etc;
Understand you are purchasing a product that is being sold by the Brand (listed as the seller for the Product Event) and the Brand is responsible to fulfill and ship all purchases that are successfully completed through the Raqk Services in accordance with the Customer order details;
Have provided accurate payment, billing, and shipping information as part of the checkout process;
Will contact the Brand with any questions about the Product, Product Event, or your purchase or Transaction; and,
Agree to comply with all applicable laws and regulations that may apply to the purchase and delivery of each product that you purchase.
Raqk does not endorse, guarantee, make representations, or provide warranties for or about the quality, safety, morality or legality of any product, Product Event, Raqk Shop, User or the truth or accuracy of User Content posted on a Raqk Shop, Product Event, profiles or other areas of the Raqk Services.
You Agree to Contact The Brand Regarding Your Purchase or Any Concerns Regarding The Product
Customers should work with and contact the Brand directly regarding any concerns about their purchases or Transactions. The Brand’s contact information is provided in your order confirmation email. The Brand’s contact information is also provided in a profile page that is easily accessible by clicking on the Brand’s name, which appears in each Product Event under the product name. Raqk does not own or control the products, the Brands, the Shop Curators or the Product Events, therefore, Raqk is not able to become involved in disputes between Customers, Brands, Shop Curators, and other third-parties using Raqk.
Where’s my package? Please contact the Brand directly regarding your purchase and the whereabouts of your package. Brands are responsible for shipping products that are successfully completed through the Raqk Services and in accordance with the Customer order and the parameters laid out in the Product Event.
Damages or mistakes to Your order? Please contact the Brand directly regarding any issues with your order, such as damage to items or mistakes to your order. The Brand may request additional information such as photos or written descriptions about any damage to the product or a mistake to the order in its sole discretion. Because some of the products are limited in quantity, a replacement may not be available; however, in each case, it is the Brand’s responsibility to work with you on a resolution to any issues with your order.
Did not receive Your package? Please keep in contact with the Brand if you do not receive your package within a reasonable timeframe after it is shipped, so that the Brand can work to determine the whereabout of your package. Staying on top of delivery is important to getting the cooperation of the shipping services that might be used. In addition, if the shipment is international in nature, you may need to reach out to your local customs office regarding your package.
Need to change Your shipping address? If you need to provide an updated shipping address, please reach out to the Brand as soon as possible. In some cases, there may be an additional shipping cost for your updated shipping address that will need to be collected prior to shipping your package to the new address.
Refunds or exchanges? Any returns, refunds, or exchanges should be addressed by contacting the Brand directly. Customers should work with and contact the Brand directly regarding any concerns about their purchase or Transaction.
In accordance with the Raqk Terms, any User of Raqk, whether they be Customers, Brands, Shop Curators, or any other person, are expected to work together to reach a mutually satisfactory resolution to any disputes. Moreover, all Raqk Users are legally bound to perform on any promises and/or agreements made with one another and to communicate respectfully, truthfully, and promptly to each other.
Release of Raqk: As part of your use of the Raqk Services, you agree to release Raqk from any claims, demands, and damages arising out of disputes with other Users of the Raqk Services.
You agree to provide accurate purchase and shipping information
You agree to provide current, complete, accurate and valid purchase, billing and shipping information for all purchases made and at the time of placing an order.
Mail forwarders: Brands are not responsible for missing or damaged product if sent to an international address via a mail forwarding service. Brands are only liable to ship a product to the actual shipping address provided to them at the time of purchase.
You Agree to Pay for Country-Specific Import Cost, And Abide By Country-Specific Import Rules
The total amount for your order may not include any duty, VAT, taxes or other customs fees required by your country’s customs office. You, the Customer, understand and agree that you may be responsible for the payment of any duties or taxes related to any purchases.
Certain taxes may be applied by the destination country to which your products will be delivered. You will be treated as the importer of record for the purpose of customs and border processing. As the importer of products, you agree that you may be liable to pay such taxes with respect to the products to the relevant authority. It is your responsibility to determine whether any such taxes apply in your destination country for delivery or the country from which the products are shipped. You agree that neither Raqk, nor the Brand, nor the Shop Curator are liable to you with respect to any loss, damage, cost, expense or injury you incur as a result of your obligation to pay taxes in a particular jurisdiction.
Please be mindful of your country’s import restrictions as Brands do not have control over your country’s customs regulations and therefore, will not be responsible for confiscated packages. Please check with your local customs office to make sure an item can be imported into your country before purchasing. Based on your country’s import laws, you may be responsible to pay duties and/or taxes for your package. You agree to comply with all applicable laws and regulations for the purchase and delivery of each product that you purchase.
You agree to receive communication
When you make a purchase in a Raqk Shop or visit the Raqk Services and communicate with us electronically, you agree that you may receive communications from Raqk, Raqk Services, and Raqk Users. Email notifications will be sent via the Raqk Services to the email address provided at the time of purchase regarding your order. You agree to be responsive to any notifications and communication regarding your order. You agree to communicate and respond respectfully, truthfully, and promptly to any Raqk Users communicating with you. You agree that all agreements, notices, disclosures and other communications that are provided to you electronically satisfy any legal requirements that such communications be in writing.
You agree to the payment processor services
Payment processing services within the Raqk Services are provided by Stripe, Inc. ("Stripe"). As a condition to Raqk enabling payment processing services through Stripe, you agree to provide Raqk accurate and complete information about yourself for payment processing, and you authorize Raqk to share any such information with Stripe, as well as other information related to the Transaction or your use of the payment processing services provided by Stripe. We are not responsible for the performance of any third-party credit card processing or third-party payment services.
All prices are listed in USD. Payment must be complete and verified before a purchase is complete or successful.
Termination of service // our right
We reserve the right to cancel or remove any Product Event at any time and we reserve the right to refuse or cancel any order placed within the Raqk Services at any time. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be fraudulent or are using the Raqk Services in a manner that violates the Raqk’s Terms. We reserve the right to lock down or freeze any User Account or Raqk Shop. In the event that we cancel an order or Product Event, or terminate your use of the Raqk Services, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time your order was placed. If you do not follow the Raqk Terms or these Terms of Purchase, we may cancel your order. In addition, we reserve the right, but are not obligated, to limit the sales or use of Raqk Services to any person, geographic region or jurisdiction at any time. We may exercise this right on a case-by-case basis in our sole discretion.
The Raqk Services and Collective Content are protected by copyright, trademark, intellectual property rights and other laws of the United States and foreign countries.
You understand Raqk’s limitations as a venue
Raqk provides its Services as a neutral venue for Customers to enter into Transactions with Brands and Shop Curators. It is important to note, however, that Raqk is not part of that Transaction and Raqk does not manufacture, store or inspect any of the items sold through the Raqk Services. By shopping, using or visiting Shop hosted by the Raqk Services, you understand that:
You are not buying directly from Raqk, but instead are buying from one of the many Brands using the Raqk Services;
Raqk does not pre-screen Brands, Shop Curators, products, Product Events or User Content or third-party Content and therefore does not guarantee or endorse any item sold through or any Content posted using the Raqk Services;
Each Brand and Product Event has their own processing times, shipping methods, policies, and other parameters;
Brands and Shop Curators are legally bound to fulfill on the promises that they make to you.
Raqk does not oversee the performance of Product Events or Raqk Shops or represent that products will be delivered or Customer orders satisfied, or guaranty the accuracy of any Content posted. By using the Raqk Services, you acknowledge that all Content you access and actions you take through the Raqk Services is at your own risk, and that Raqk will not be responsible for any resulting claim or damage. Raqk is not liable for any damages or losses related to your use of the Raqk Services. When you use the Raqk Services, you release Raqk from claims, damages, and demands of every kind arising out of or in any way related to the Raqk Services. Remember, Raqk does not own or control the products, the Brands, the Shop Curators or the Product Events, therefore, Raqk is not be able to become involved in disputes between Customers, Brands, Shop Curators, and other third-parties using Raqk.
